TERMS AND CONDITIONS
797 Performance always recommends professional installation of parts by a certified mechanic operating from a professionally licensed and insured automotive shop.  Warranties are held by the end-user and any or all claims should be directed to the parts manufacturer/maker.  797 Performance does not imply any extra, extended, or warranty of any kind outside of the manufacturer's or makers' warranty. There is no warranty or financial compensation for installation or labor of any kind.  It is the sole responsibility of the consumer to confirm that all parts are correct. We advise against installing, scheduling installation, or service until the parts received are verified to be correct and in good order.

Parts installed onto a vehicle with a manufacturer or third-party warranty are at the discretion of the buyer.  Altering the vehicle may nullify these warranties.  797 Performance is not liable for vehicle warranty denial or cancellation.

All parts sold are for racing and off-road use only.  Parts installed onto a road vehicle are at the sole discretion of the purchaser and 797 Performance has been released of all liability.

Due to sales tax Nexus Laws and regulations state by State 797 Performance may or may not charge sales tax in your state.  As the purchaser, it is your obligation to pay any and all sales or use tax that was not collected.  Check the tax laws with your state for more information.

PROCESSING AND HANDLING TIMES
Please note that we try to process and ship items quickly, however, it takes some time to process or secure your ordered items before they are shipped.  Some items may be shipped from a supplier, the manufacturer, or a third party and can be subject to lead times.   If there is an extended lead time, we will do our best to reach out as soon as we have an eta.  Our site does not have a live inventory.  ETAs are "ESTIMATED", there is no guarantee or implied promise dates.

CANCELLATIONS

Orders cannot be canceled if they have been shipped, there is a minimum cancellation fee of $15.00, or a 4% fee will be applied to orders paid via credit card or PayPal, 5% will be applied to orders paid via Google or Apple pay, 8% will be applied to orders paid via Shop Pay Installments, Affirm, or Klarna.  Snap orders will have to be canceled by Snap, please call them at their support number to initiate an application withdrawal. Orders shipped cannot be canceled and would be subject to the return policy.  Special Order items may not be canceled.

ID VERIFICATION
Id may be requested in order to verify identity or military status.  This information is attached to your customer profile and is never shared or resold.

SALES, DISCOUNT CODES, PROMOTIONS
Sales, Discounts, or Promotions are subject to change at any time.  Coupon codes do not work on all items.  Some items have set pricing and the manufacturer does not allow us to discount them.  However, we do offer discounts, bundle pricing, military discounts, club and group discounts, ETC.  There are no discounts on scratch and dent items.

Refund & Return Policy

RETURNS
The purchaser may return items but is responsible for the return shipping of the item. The cost of shipping of the original order will not be refunded.  We can supply a return label if requested, but the cost of the label will be deducted from the return refund as well as the restocking fee, and the original shipping charges.  Items must be returned in good unopened condition. There will be an 18% restocking fee for uninstalled merchandise in new condition.  Handled items in good condition that can be resold at a discounted rate will have a 25-50% restocking fee.  This will be determined at the inspection of the return.  All items returned will need to be inspected prior to issuing a refund.  Items returned in poor or unsalable condition will not be refunded, an offer to ship the item back will be offered otherwise the item will be disposed of. 

Returns must be initiated within 15 days of delivery and returned to 797 Performance within 30 days of delivery.  No exceptions will be made.  Used or parts that have been installed will not be accepted on return unless they are defective.  Defective parts will require RMA from the manufacturer or our supplier.  Photos may be required.

SPECIAL ORDERS / CLEARANCE ITEMS
Special order & clearance items are items that are not normally carried or stocked and are ordered specifically for an order. Special order items cannot be returned or canceled, there is no exception to this policy.  Special order items will also have extended ETA's as they may need to be manufactured or shipped from another area of the world. Special order brands are Addictive Desert Designs, Baja Designs, APR, Anderson Composites, Seibon, Weld Racing, HP Tuners, Diablo Sport, RipaTuned, Mopar oem parts, FI Interchillers, ReTrax, 797 Performance Brake Conversion Kits and more not limited to.  All exterior items and body parts are special order.

DEFECTIVE ITEMS
If an item is defective out of the package, we will work with the manufacturer on getting the item replaced. 797 Performance will determine the condition of the item. However, all warranties are held with the manufacturer of the part. We may direct you to the manufacturer or we may start the facilitation, but the warranty is always held with the manufacturer or maker of an item.

Refund vs return, all parts must be returned and inspected before a refund is issued, alternatively, a replacement part can be shipped prior to a part being returned, but it will be invoiced in full and refunded when the returned part is received and inspected

CANCELLATIONS
Orders cannot be canceled if they have been shipped, there are order cancellation fees. This is because the platform and payment processing companies do not refund those fees to us.  The cancellation fee is the actual fee's incurred plus 2% of the total transaction. Most cancellation fees are between 4.6% - 9% of the total order.  Snap orders will have to be canceled by Snap, please call them at their support number to initiate an application withdrawal after speaking with us. Orders shipped cannot be canceled and would be subject to the return policy.  Cancelations past 15 days will be processed and issued as store credit only.  Special Orders and / or clearance items may not be canceled. The reason we have a cancellation fee, is because even if we cancel your transaction, we still have to pay the processing and transaction fees.  This just prevents us from having a negative net transaction based on a cancellation.


Note:
If you place an order and attempt to cancel it immediately or within a few hours it may take us time to do so.  This is because our systems are tied to some of our suppliers’ systems and the order is processed immediately.  It may take us to the end of the next business day or longer to attempt to cancel with these suppliers.  Sometimes the item will ship before an agent at the supplier see's our request to cancel.  CANCELLATION REQUESTS ARE NOT IMMEDIATE OR GUARANTEED AND MAY NOT ALWAYS CANCEL THE ORDER.

CARB RESTRICTED ITEMS:  If you purchase an item that is not eligible to be shipped to California or a CARB-adopted site that item will be canceled from the order.  If it is a single item order the entire order will be canceled.  The cancelation fees will apply

ROUTE PACKAGE PROTECTION IS NON-REUNDABLE:
Route package protection insurance shall not be canceled, modified, or refunded.  This applies to orders or items that have been canceled by the customer or 797 Performance LLC. All Route Package protection orders are final.

Please note we do not accept returns on scratch & dent items, clearance items, tires, suspension components, differentials, axles, driveshafts, nuts, bolts, engine hardware/fasteners, internal engine components, engine bearings, pistons, rods, crankshafts, camshafts or cam kits, throttle bodies. forced induction systems, gaskets, wheels that have been mounted, opened box electronics, opened lighting products, fuel control/delivery devices, fuel/engine management systems, headers, mid-pipes, exhaust systems, bed-covers or emissions-related equipment. 


ACKNOWLEDGMENT OF COMPETITION USE & RELEASE AND ASSUMPTION OF RISK AND LIABILITY

ALL PARTS SOLD ARE A “RACE ONLY” PRODUCT USED SOLELY FOR COMPETITION. Its use is limited to closed-course and open-course racing that is formally sanctioned by a recognized racing organization. Any other use, including recreational off-road use, could be in violation of local, state, and federal laws. Please read, understand, and accept all the terms of this Acknowledgement before purchasing and installing this product.

  1. By installing this product onto your vehicle, you assume all risk and liability associated with its use.
  2. It is your responsibility to make sure your vehicle complies with all local, state, and federal emissions laws. These laws prohibit the removal, modification, or rendering inoperative any part that affects emissions or the safety of a motor vehicle that is used on a public street, road, or highway. All civil penalties and fines for removing your vehicle’s emissions equipment are the sole responsibility of the end user.
  3. Use of this product may void the vehicle manufacturer’s warranty.
  4. 797 Performance is not responsible for the misuse of its products. By installing this product, you release 797 Performance of any and all liability associated with its use.
  5. Depending on where you live, restrictions may apply. Check all applicable laws before installing or using this product.
  6. The purchaser/end-user releases, indemnifies, discharges, and holds harmless 797 Performance from any and all claims, damages, causes of action, injuries, or expenses resulting from or relating to the use or installation of this product that is in violation of the terms and conditions of this document, on the manufacturer's product packaging and/or the manufacturer's instruction sheets. 797 Performance will not be liable for any direct, indirect, consequential, exemplary, punitive, or incidental damages or fines resulting from the use or installation of this product.

    In witness thereof, I executed this Acknowledgement of Competition Use and Release and Assumption of Risk and Liability form having fully read and understood and willingly agreeing to acknowledge all of its terms.

SHIPPING POLICY

SHIP TO ADDRESS

Unless contacting us prior, we only ship to the confirmed PayPal or credit card billing address. If we cannot contact you, the order will be canceled within 48 hours.  Cancellation fees will apply.

ESTIMATED SHIPPING
All shipping dates are estimated, there are absolutely no guarantees by a certain date.  These dates are based on UPS averages on parts ordered and shipped before 3 PM on a non-holiday when it is in stock at our location only.

PO BOX
Unless contacting us prior, we do not ship to PO boxes.  Special exceptions may apply but it will be billed at the actual rate.

ADDRESS CHANGES
A $25.00 fee will be applied to any address changes.  797 Performance can only ship to verified PayPal or Credit Card Billing addresses only.

LOGISTICS
UPS/FedEx/and USPS do not operate in real-time.  There is a delay in their tracking, this can be up to 24 hours.  For example, a package could be picked up on a weds at 4 PM but not show that it was picked up until the next day.  Or a package can show delivered hours after it actually was.  Once the package is in their system, we have the same information you have and we cannot provide more detail.

PACKAGES LOST IN TRANSIT
Sometimes a package will become lost or damaged in the possession of the shipping company.  Most times the package will take some time, it will re-appear and continue to the destination.  If a package's tracking goes stale, we will work on getting a replacement part sent after a reasonable time has passed.  A reasonable time is 15 days or more from the last scan of the tracking of the package.  Why 15 days? Because sometimes it naturally takes 5-7 days for certain packages to travel between hubs and get scanned.  This allows 8-10 days for the package to find its way back into the system and continue traveling.  After this period time, we will start a lost claim and work on getting a replacement sent out.  We cannot issue a new package before this time has expired. If you cannot wait, we can offer to sell a new item and refund the lost package after the carrier has deemed the package lost.  If a package cannot be located but there is proof of delivery you will need to contact the shipping company to advise you cannot locate the item.  They may have notes or details as to the whereabouts and they may be able to verify whether or not the package was scanned at the correct destination address. We cannot open claims on your behalf if a package indicates that it has been delivered.

STOLEN PACKAGES
797 Performance LLC is not responsible for packages that are lost or stolen after a delivery is made.  Please check the tracking to verify the delivery photo, if applicable.  If you cannot locate the package, please contact the shipping company to verify it was delivered to the correct address.  Most shipping companies take photos or scan the package with the GPS tag and can verify the location of the package.  They can also track it down in the case of a mis delivery.  It is also wise to check with your neighbors. The responsibility of the carrier is to make the delivery to the address, if the package is stolen after the delivery was made there will be no financial compensation or replacement.  Route Package protection will cover lost or stolen packages, but this insurance service must be purchased when checking out.  It cannot be added to an order after checkout has been completed.  Stolen packages without Route package protection are not covered by 797 Performance, Route, or any other service.

DAMAGED SHIPMENTS / ITEMS MISSING PARTS / INCORRECT ORDERS
If a package is received damaged or missing parts, we will do our very best to correct the situation.  We will send a prepaid return label and once the package is verified to be in transit we will ship a replacement part if that part is in stock, otherwise it will be ordered and will ship when it becomes available.  If it's an item that drop-shipped from a supplier or manufacturer we will need to obtain the return label from them, this can take up to 2 business days.  Photos of the damage are always required.  A replacement part cannot be shipped before the damaged part being in transit to return or has been returned.  Alternatively, we can sell you a duplicate order and refund you in full when the damaged item is returned.

MULTI-PIECE ORDERS
Sometimes if you purchase 4 wheels, or 4 tires FedEx or UPS will deliver 3 one day and 1 the next day. This is out of our control and it is not considered a concern because at times shipments can get separated as they are in transit. Also, sometimes half of your order will ship from our inventory and the other half from the supplier, we input tracking numbers daily, please use the customer account to get the most up-to-date information on your order, tracking, etc.

INTERNATIONAL ORDERS
We can ship to some international addresses, please contact us for a shipping quote and provide the full address and phone numbers along with a copy of the shopping cart.  The VAT, Taxes, and/or duties may be collected upon delivery, we do not have control over these taxes / importation fees and they are the sole responsibility of the purchaser.

ROUTE PACKAGE PROTECTION
797 Performance offers Route Package Protection at checkout.  This is a third-party insurance provider that covers lost, stolen, or damaged packages.  The premiums collected are transferred to Route and 797 Performance does not profit from this service.  Package claims with Route Package protection are handled directly by Route.  All purchases of Route package protection are final and cannot be reversed, modified, or canceled.  Route Package protection is not refundable.

 

 

INVENTORY STATUS, FACEBOOK & GOOGLE

797 Performance does not have a live inventory system.

ETA means ESTIMATED TIME OF ARRIVAL. This is a vendor estimate on when we should receive an item.  It is not a guaranteed date, and is subject to change and often can.  ETA to us does not include checking items into stock, handling time and shipping time to you. 

Google and Facebook shopping will estimate shipping times and do not have access to our inventory. They post this as a disclaimer on their sites, but it is hard to find and often missed.  This will present to a customer so that we may have it available in stock and ready to ship when we don't.   We always ask that you use the live chat or email to check with us to verify an item is in stock before you check out.  We are not responsible for the incorrect information of advertising partners as they do have disclaimers posted.  If you were led to believe an item was in stock and wish to cancel, it will be subject to the cancellation policy.
